Terms of Service & End User License Agreement (EULA)

1. Agreement to Terms and End User License Agreement

By downloading, installing, or using the Elfie Spot Finder mobile application (the "App"), you agree to be bound by these Terms of Service and End User License Agreement ("Terms" or "EULA"). If you do not agree to these Terms, do not download, install, or use the App.

This End User License Agreement ("EULA") is a legal agreement between you and Elfie Spot Finder for the App. The App is licensed, not sold, to you for use only under the terms of this EULA.

2. Description of Service

Elfie Spot Finder is a mobile application that uses AI technology to suggest creative hiding spots for holiday elf activities. The App provides spot suggestions, photo storage, and related features.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App and that they have agreed to these Terms on your behalf.

4. Account Registration

Some features of the App may require you to create an account. You agree to:

• Provide accurate and complete information
• Maintain and update your information as necessary
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account

5. Auto-Renewable Subscription and Payment

Subscription Title: Elfie Spot Finder Pro
Subscription Length: Monthly (1 month)
Subscription Price: $2.99 USD per month
Price per Unit: $2.99 USD per month

The App offers a 7-day free trial period, after which a monthly auto-renewable subscription fee applies. By subscribing, you agree to:

• Pay all fees associated with your subscription
• Automatic renewal unless cancelled at least 24 hours before the end of the current period
• Your subscription will automatically renew each month unless auto-renew is turned off
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase
• Any unused portion of a free trial period will be forfeited when you purchase a subscription
• Price changes will be communicated with at least 30 days notice

Subscriptions are managed through the Apple App Store. Cancellation must be done through your Apple ID account settings at least 24 hours before the end of the current period. No cancellation of the current subscription is allowed during the active subscription period.

6. User Content

You retain ownership of photos and content you create or upload to the App. By using the App, you grant us a limited license to use, store, and process your content solely for the purpose of providing the App's services. Your content is stored locally on your device and, if enabled, synced to cloud storage.

7. Prohibited Uses

You agree not to:

• Use the App for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit harmful code or malware
• Attempt to reverse engineer the App
• Interfere with the App's operation

8. License Grant and Intellectual Property

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device solely for your personal, non-commercial use.

The App, including its design, features, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, create derivative works, reverse engineer, decompile, or disassemble the App without our express written permission.

This license does not grant you any rights to use our trademarks, service marks, or logos. All rights not expressly granted are reserved.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the App will be uninterrupted, error-free, or secure. AI suggestions are provided for entertainment purposes and should be used with appropriate safety considerations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. You may stop using the App at any time by deleting it from your device.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
